These Terms govern transactions that are economically small but administratively investigated in full: the paid pressing of a red internet button and the separately paid review of a twelve-digit classified combination.

§ 1

Scope and file-handling competence

These Terms apply to contracts for the digital “Only a Button” offer on onlyabutton.de and onlyabutton.com between Patrick Brockhaus, trading as “Only a Button”, and the person placing the order.

Any differing terms of the ordering person apply only if expressly accepted in text form. Individual agreements and mandatory consumer law take precedence.

§ 2

Eligibility and legal-capacity record

Orders may be placed by adults with full legal capacity. Minors may initiate the transaction only with the valid consent of their legal representative. The Button does not verify age; the law may nevertheless do so in a dispute.

§ 3

Subject matter of the paid administrative imitation

For a Button press, the contract concerns a one-time digital entertainment experience. Once payment is confirmed, a Button press is registered and an individually designated digital certificate with its own file number is provided.

For the combination lock, the contract concerns only the one-time technical review of the exact twelve-digit combination entered before checkout. The result is either accepted or rejected. A review attempt creates neither a Button press nor a certificate or public file number. No physical goods are shipped in either case.

  • The certificate is not a government document and has no official, notarial or evidentiary effect.
  • File numbers, check digits, stamps and other official-looking features form part of the performance.
  • No particular visual execution or economic value is owed.

§ 4

Formation of contract and end of mere temptation

Pressing the red Button or requesting a lock review merely opens the checkout supplied by Stripe and does not itself place an order requiring payment. Only the clearly payment-labelled confirmation in that checkout constitutes a binding offer. The contract is concluded when payment is accepted and the respective digital result is made available.

Input errors may be corrected using the checkout controls before payment confirmation, or the process may be cancelled without consequence. The language displayed in checkout is the contractual language.

§ 5

Price determination and payment processing record

The total price shown in checkout immediately before the order is placed applies, including any applicable taxes. Payment is processed by Stripe using the payment methods offered there. Vouchers, payments in kind and verbally promised button quotas are not accepted.

Each lock review is a separate transaction charged at the amount shown in checkout, ordinarily $1. The charge is due for proper review and does not promise that the combination is correct or create a right to unlimited further entries.

§ 6

Immediate digital supply

Supply generally occurs immediately after successful payment confirmation. Short delays in payment services, webhook delivery or database processing are technically possible and do not by themselves constitute permanent non-supply. The ordering person requires a current browser and an internet connection.

The certificate may be retrieved as a PNG and displayed again through its public certificate address. Once supplied, the ordering person is responsible for keeping any permanent personal copy.

The result of a lock review is displayed in the combination lock immediately after returning from Stripe. The temporary result entitlement is technically bound to the same browser and intended for short-term display.

For successfully paid transactions, Stripe provides an electronic invoice and contract confirmation to the email address supplied in Checkout. It records the subject of the contract together with the consent to immediate performance and the acknowledged loss of the right of withdrawal declared in Checkout.

§ 7

File numbers and proper allocation

Each successfully paid individual transaction receives a separate public file number. It is used solely to identify and retrieve the associated digital certificate.

The file number is not a payment instrument, a tradable security or a promise of performance beyond the subject described in Section 3. No contrary official presumption is established.

§ 8

Voluntary entry in the public register of weakness

A display name and city may be added voluntarily. The entries are displayed publicly together with certificate details. A pseudonym may and should be used. Anyone who enters nothing still receives the contracted certificate.

Entries that are unlawful, insulting, discriminatory, misleading or infringe third-party rights are prohibited. Such entries may be removed, shortened or technically blocked.

§ 9

Licence to use the certificate

Upon supply, a simple, non-exclusive, unlimited-term and non-transferable licence is granted to store, reproduce and share the specific certificate for private purposes, including on social networks. No right is granted to appropriate the trademarks, source code, design system or other parts of the service, or to present them as one’s own official service.

§ 10

Right of withdrawal and early expiry

Right of withdrawal

Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The period begins on the day the contract is concluded. A clear statement sent by email or post to the person and address identified in Section 1 is sufficient.

In the event of withdrawal, payments received will be reimbursed without undue delay and no later than fourteen days after receipt of the withdrawal statement, generally using the same means of payment.

Special rule for immediately supplied digital content

For digital content not supplied on a tangible medium, the right of withdrawal expires early where the consumer expressly agrees to performance beginning before the withdrawal period ends, confirms knowledge that this causes the right to be lost, and a statutory contract confirmation has been supplied. These declarations are requested in checkout before payment. If the statutory requirements for expiry are not met, the right of withdrawal remains in force.

§ 11

Statutory remedies for defects

Statutory rules on digital products apply, including Sections 327 et seq. of the German Civil Code where applicable. If a certificate is not supplied, is technically defective, or a review result is not displayed after confirmed payment, the customer may request investigation and, where due, remedy by contacting the address in Section 1 and providing the payment time or Stripe receipt number.

§ 12

Allocation of liability

Liability is unlimited for intent and gross negligence, injury to life, body or health, under product liability law and in any other case where liability is mandatory by law.

For a slightly negligent breach of an essential contractual obligation, liability is limited to the typical foreseeable loss. Liability for other slight negligence is excluded. Statutory remedies for defects are not restricted by this provision.

§ 13

Final provisions, governing law and dispute notice

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice applies only insofar as it does not deprive them of mandatory protection under the law of their country of habitual residence. Statutory jurisdiction rules remain unaffected.

The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Each purchase is governed by the version of these Terms supplied when the contract is concluded. Later changes do not apply retroactively to completed individual transactions.
